However, that detention cannot extend beyond the “reasonable time” necessary for removal. The United States Supreme Court has stated that the "reasonable time" should not exceed 6 months. Should we allow for a longer detention if the delay is because the detainee’s home country refuses to take the detainee back? Why/why not? Assuming that we do permit a longer detention, should we allow indefinite detention in those cases? Why/why not?
